Republican AGs Seek to Unplug the DOE’s Fuel-Economy Rule for Electric Vehicles

  • A group of 13 Republican AGs and the American Free Enterprise Chamber of Commerce filed a petition for review of the DOE’s Petroleum-Equivalent Fuel Economy Calculation final rule—which provides the procedures for calculating values for the fuel economy of electric vehicles.
  • According to the petition for review, the DOE allegedly lacked authority to impose a fuel-content factor that multiplies the nominal fuel-efficiency of electric automobiles by a specific factor, lacked authority to apply the rule to a specific timeframe, and failed to perform the Environmental Impact Statement required by law. The petition also alleges that the rule is arbitrary and capricious.
  • The lawsuit seeks declaratory and injunctive relief, among other relief.
