- According to the petition for review, the DOE allegedly lacked authority to impose a fuel-content factor that multiplies the nominal fuel-efficiency of electric automobiles by a specific factor, lacked authority to apply the rule to a specific timeframe, and failed to perform the Environmental Impact Statement required by law. The petition also alleges that the rule is arbitrary and capricious.
