Cozen O'Connor State Attorneys General Practice Co-Chairs Weigh in on the Expected Rise in State Attorney General Actions

Bernie Nash and Lori Kalani, Co-Chairs of Cozen O’Connor’s State Attorneys General Practice, discuss with Law360 the likely rise in enforcement activities by state AGs, the widening array of legal and policy issues AGs tackle, and the changing dynamic between AGs and federal regulators. Kalani and Nash share the perception that AGs may take on more assertive consumer protection enforcement roles should President Trump’s administration move forward on promises to soften federal regulations.  Nash told Law360, “For the next four years, if not longer, you’re seeing a different philosophy with respect to federal enforcement…So if there’s less federal enforcement, state AGs may feel they need to be doing more in those areas.”

Kalani, who first developed her state AG knowledge while a former in-house counsel, noted that AG practices like Cozen’s were created to meet growing client demand for state AG-tailored legal services and entail a lot of work “atypical of a law firm.”  Nash, who pioneered the state AG practice nearly 40 years ago, added, “[t]he smart general counsels know that if you have a state AG problem, you need a state AG firm.”
