- Indiana AG Todd Rokita led a bipartisan coalition of 16 states in a lawsuit against Indiana-based EIDP, Inc., the chemical company formerly known as DuPont, its parent Corteva, and a newly created entity, Vylor.
- The suit challenges an October 1 transfer of the Pioneer seeds business from DuPont and Corteva to Vylor, which the states allege left significant PFAS-related liabilities with DuPont while moving valuable assets to the new company, representing roughly three-quarters of the value that could potentially be available to satisfy claims.
- The states are asking the court for a temporary restraining order freezing the assets, which would stop DuPont and Corteva from using remaining funds for dividends and stock buybacks and stop Vylor from selling or pledging the seed assets it just received.
- The lawsuit follows a 2024 Indiana case against 22 PFAS manufacturers including DuPont, Corteva, Chemours, and 3M alleging that the companies concealed information about PFAS risks and continued selling the chemicals.
