- Florida AG James Uthmeier filed a lawsuit against insulin manufacturers Eli Lilly, Novo Nordisk, and Sanofi, as well as pharmacy benefit managers CVS Caremark, Express Scripts, and OptumRx. The lawsuit also names rebate aggregators Zinc, Ascent, and Emisar.
- Filed in the Eleventh Judicial Circuit, the complaint alleges the companies engaged in practices that contributed to higher published list prices for insulin and other diabetes medications. The state alleges that manufacturers provided rebates and fees to PBMs in exchange for preferred placement on drug formularies.
- The lawsuit also addresses several GLP-1 and combination medications, including Ozempic, Trulicity, Victoza, and Soliqua. The complaint alleges violations of the Florida Deceptive and Unfair Trade Practices Act and the Florida Antitrust Act. Florida is seeking a permanent injunction, restitution, disgorgement, damages, civil penalties, and other relief.
