Republican AG Coalition Sues EPA Over California Emissions Standards

  • A coalition of AGs from 17 Republican states filed a Petition for Review in the District of Columbia Circuit of the EPA’s reinstatement of California’s ability to independently set emissions standards under the Clean Air Act.
  • The Petition alleges that EPA Administrator Michal Regan violated the Constitution’s doctrine of equal sovereignty by giving California an exemption from the Clean Air Act and allowing the state to impose more stringent emissions limits than the nationwide standard.
  • The exemption was previously granted to California in 2013, but was revoked by the Trump administration in 2019. This March, Regan announced the waiver would be restored.
