Ten Republican Attorneys General Sue Biden Administration over Climate Change Metric

  • A group of ten Republican AGs, led by Louisiana AG Jeff Landry, sued the Biden administration over an alleged violation of the Administrative Procedures Act by President Biden in issuing an executive order restoring Obama-era calculated values for an analytical tool called the social cost of greenhouse gases, values that agencies use to assess the harm caused by emissions of carbon dioxide, methane, and other gases. The Trump administration had previously cut the value.
  • The complaint alleges that the executive order violates the Administrative Procedures Act because the original social cost values were promulgated without following proper public notice and comment procedures, and further alleges that the executive order will result in thousands of jobs being lost and significant tax revenue losses to the plaintiff states.
  • The complaint seeks declaratory and injunctive relief barring agencies from using the Biden administration’s values for the social cost of greenhouse gases.
