DC AG Says Landlord Hid the True Cost of Rent

  • District of Columbia AG Brian Schwalb sued property owner and manager Mid-America Apartment Communities, Inc. and its subsidiaries for allegedly violating the DC Consumer Protection Procedures Act and Rental Housing Act by charging illegal junk fees and hiding the true cost of apartment rentals.
  • According to the complaint, MAA charged tenants fees the AG says were illegal, including a processing fee that allegedly served no purpose, a roommate release fee above the legal cap, and a monthly “community fee” for basic common-area upkeep that landlords are required to provide as part of rent.
  • The AG’s office further alleges that MAA advertised deceptively low “base” or “starting at” rents that excluded mandatory monthly fees and hid other event-based fees from prominent fee disclosures and rental listings.
  • The District seeks injunctive relief, restitution, damages, civil penalties, costs, and attorneys’ fees.
