AI Safety: New York AG Leads Coalition Calling for Federal AI Regulation, While Florida AG Seeks Temporary Injunction Against OpenAI

  • New York AG Letitia James led a bipartisan coalition of 25 other AGs urging Congress to begin regulating the artificial intelligence (AI) industry. The coalition alleges that reports of recent incidents demonstrate that unchecked AI development endangers Americans and poses a potential threat to our financial system, critical infrastructure, and national security.
  • The coalition letter emphasizes that any AI regulatory scheme considered by Congress must include federal oversight of safety testing and standards, uniform and transparent government-led incident response with public findings, safety infrastructure, experienced leaders to make critical safety decisions, international cooperation to pace AI advancement, and prohibition on preemption of state laws and full authority for state officials to enforce federal protections.
  • Separately, Florida AG James Uthmeier filed a temporary injunction against OpenAI and its CEO Sam Altman as part of the state’s legal action against the company. AG Uthmeier’s motion seeks to temporarily enjoin OpenAI from developing any AI models without independent third-party guardrails and approval, offering ChatGPT to and collecting and processing any data from minors in Florida, and misrepresenting the safety and characteristics of ChatGPT, among other things.
