Democratic AGs Take U.S. Department of Education to School Over Administration Directives

  • A group of 21 Democratic AGs obtained a preliminary injunction preventing the U.S. Department of Education (DOE) from taking further steps to dismantle the agency.
  • In the court’s order, it found that the states and plaintiffs from a consolidated lawsuit were likely to succeed in demonstrating the unlawfulness of the DOE’s reduction in force and President Trump’s directives directing the DOE’s closure and for the DOE to transfer student loan management and special education services outside of the agency
  • We have previously reported on a lawsuit filed by 19 Democratic AGs to block the DOE from enforcing a directive conditioning federal education funding on certification that state and local education agencies will not engage in illegal diversity, equity, and inclusion practices.
