- Florida AG James Uthmeier has filed two lawsuits against companies operating online pornography platforms, alleging that they failed to implement safeguards to verify users’ ages, in violation of a new state age-verification law and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA).
- One complaint was filed against Gethins Limited, Toccata, Inc., Segpay Gateway LLC, and Segregated Payments, Inc., D/B/A Segpay. The other was filed against Aylo Holdings USA Corp., Aylo Billings US Corp., Aylo Group Ltd, and Nutaku Entertainment Ltd.
- According to the complaints, the companies allegedly failed to implement systems verifying that users are 18+ before accessing sexually explicit content, including pornographic video games, as required by Florida law. The lawsuits allege violations carrying civil penalties of up to $50,000 per violation. The complaints also assert that the companies profited from youth exposure through unfair, deceptive, and unconscionable business practices, in violation of FDUTPA.
- The lawsuits seek injunctive relief, full compliance with state law, civil penalties, and attorneys’ fees, plus other available relief.
