Kentucky AG Brings Latest Opioid Epidemic Lawsuit

  • Kentucky AG Russell Coleman filed a lawsuit against the Kroger Company and affiliated entities alleging that it contributed to the opioid epidemic in the state in its role as a drug distributor and operator of retail pharmacies.
  • According to the complaint, Kroger allegedly distributed and dispensed opioids in the state between 2006 and 2019, while disregarding indicators that the drugs were being misused, abused, or diverted illegally.
  • The lawsuit seeks declaratory and injunctive relief, civil penalties, costs and fees, and prejudgment interest, among other relief.
