- Pennsylvania AG Dave Sunday has filed a lawsuit against several pharmaceutical companies, including Eli Lilly and Company, Novo Nordisk Inc., and Sanofi-Aventis USLLC, and a number of pharmacy benefit managers (PBMs) regarding alleged collusion to manipulate insulin price markets and increasing out of pocket costs.
- The lawsuit alleges the companies engaged in anticompetitive and deceptive practices to create abnormally high prices. This includes the price of insulin inflated by more than 1,000 percent. The state is seeking injunctive relief requiring changes to the companies’ practices to promote fair market pricing and improve options for patients.
- Filed by the AG’s Antitrust Section in the Commonwealth Court, the lawsuit alleges violations of the state’s Unfair Trade Practices and Consumer Protection Law, as well as unjust enrichment and civil conspiracy. In addition to injunctive relief, the complaint seeks restitution for Pennsylvanians who were harmed by the conduct, as well as civil penalties and costs.
