- Arizona AG Kris Mayes settled with Reynolds Consumer Products, Inc. and Reynolds Consumer Products, LLC for allegedly violating the Arizona Consumer Fraud Act by misrepresenting the recyclability of certain plastic bags.
- According to the complaint that we previously reported on, Reynolds marketed transparent blue and clear “Hefty” bags as “Recycling” bags despite the products not being accepted by any municipal recycling programs or material recovery facilities in Arizona.
- The complaint further alleged that even after redesigning packaging to include disclaimers, Reynolds continued to use misleading imagery and terminology that implied the bags were suitable for curbside recycling programs.
- Under the terms of the consent judgement, Reynolds will pay $30,000 in consumer restitution, $157,000 to the state, and $25,000 in attorneys’ fees and costs, and it must also stop marketing the products as “recycling bags” in Arizona and redesign packaging nationwide to explicitly state “These Bags Are Not Recyclable,” among other requirements.
