Health Law 2022 Discusses Regulatory Risks for Health Businesses And How to Manage Them

Each year in early December, Cozen O’Connor’s Health Care & Life Sciences industry team hosts a Health Law Program to update clients on a wide range of issues that we believe will be critical for health care businesses in the upcoming year. This year’s program, held virtually from December 8-9, 2021, included a policy view from Washington, the latest in employment law and hot topics in reimbursement.

State AG Group member Meghan Stoppel spoke on “State AGs and Emerging Trends”. She cautioned that the AGs’ prominent role in their state makes it increasingly important for health care businesses to get to know them. AGs are weighing in and taking enforcement action across the health care industry. Consumer protection issues where AGs have historically taken a stance include prescription and distribution of opioids, fair pricing and deceptive and unfair trade practices. But the pandemic has raised the stakes in many new areas as well, such as telehealth and digital health services, and COVID-related fraud. As comprehensive state data privacy laws are beginning to be enacted across the country, health care businesses also need to understand the impact of new regimes and their obligation to protect consumers’ personal health data against ransomware attacks and other security breaches.
