Illinois AG Pens Latest EpiPen Deal With Mylan

  • Illinois AG Kwame Raoul reached an $8.25 million settlement with Mylan Inc. resolving allegations that the company used anticompetitive tactics to monopolize the epinephrine auto-injector market and overcharge Illinois Medicaid and employee health benefits programs for EpiPens.
  • According to the AG’s office, Mylan allegedly raised prices, delayed generic competition, forced consumers to buy two-packs instead of single pens, made misleading ads about competing products, and used contracts with pharmacy benefit managers to block competitors.
  • The AG’s office says the settlement directs most of the recovery to the Illinois Department of Healthcare and Family Services for Medicaid purchases and the Illinois Department of Central Management Services for employee health benefits purchases. Mylan also agreed to increase its copay coupon for the authorized generic version of EpiPen from $25 to $40.
  • Previously, we reported on separate Mylan settlements with Maryland and North Carolina resolving similar allegations that the company used anticompetitive tactics to maintain EpiPen’s market dominance and drive up prices.
