Another Round in the AI Feud - AG Paxton Sues OpenAI and CEO Sam Altman

  • Texas AG Ken Paxton filed a lawsuit against OpenAI Global, LLC, its affiliated entities, and CEO Sam Altman, alleging that the company misled consumers about ChatGPT’s safety and reliability and failed to disclose negative side effects.
  • The complaint alleges that ChatGPT can generate inaccurate or dangerous guidance without sufficiently warning users about its limitations and risks. AG Paxton also raises concerns about reports of AI chatbots contributing to self-harm and dangerous behavior. AG Paxton cites numerous reports that highlight the dangers of human reliance on undertrained and rogue AI chatbots and that minors have become addicted to a tool that fakes human compassion to collect their data with no parental oversight.
  • AG Paxton alleges violations of the Texas Deceptive Trade Practices Consumer Protection Act (DTPA), arguing that OpenAI’s public assurances about safety did not adequately reflect the risks described in the complaint.
  • We previously reported about multiple other investigations and lawsuits by AGs regarding alleged misconduct and consumer protection violations by OpenAI.
