FTC Targets Optometrists, Ophthalmologists Suspected of Violating Prescription Access Rules

  • The FTC announced that it sent 37 cease and desist letters to eyeglass prescribers, including optometrists and ophthalmologists, for allegedly violating the agency’s Ophthalmic Practice Rules, known as the Eyeglass Rule.
  • According to the letters, the eyeglass prescribers allegedly failed to automatically provide patients with their eyeglass prescriptions immediately after eyeglass examinations, and eyeglass prescribers charged additional fees as a condition of providing the prescription.
  • The FTC warns that violations of the Eyeglass Rule may result in civil penalties up to $50,120 per violation, and asks eyeglass prescribers to send action plans for addressing violations.
