- Nebraska AG Mike Hilgers sent cease-and-desist letters to 12 retail and franchised stores that sell synthetic THC-containing products, directing them to halt sales and return a signed Assurance of Voluntary Compliance document to avoid litigation. AG Hilgers has now sent cease-and-desist letters to every known retail store in the state that sells THC products.
- The letters warn that many THC products misrepresent the concentrations and types of THC that they contain and that such improper labeling constitutes deceptive, unfair, and unsafe trade practices. The letters further note that several of the cannabinoids being sold are synthetic Schedule I controlled substances, rendering the products illegal under state and federal law.
- We have previously reported on other consumer protection efforts by AG Hilgers related to the sale of THC products, including a series of lawsuits against retailers selling edible THC products and cease-and-desist letters sent to tobacco stores regarding the sale of marijuana products improperly marketed as hemp.
