- Montana AG Austin Knudsen filed a lawsuit against General Motors (GM) and its subsidiary OnStar, alleging the companies collected and sold customers’ driving data without consent, in violation of Montana’s Unfair Trade Practices and Consumer Protection Act.
- The lawsuit alleges that GM and OnStar enrolled its customers in a service that tracked driving behavior and sold the information to data brokers, which then provided it to insurance companies. The data reportedly included vehicle speed, seatbelt use, hard braking, and other driving metrics. AG Knudsen is seeking a permanent injunction against the alleged practices, civil penalties, and an order requiring the companies to delete and destroy all driving data, including any in the possession of a third party.
- AG Knudsen’s lawsuit follows similar actions against GM and OnStar, as we have reported previously, by the AGs of California, Iowa, Nebraska, Arkansas, and Texas, as well as the FTC.
